Terms of Service

These Terms of Service ("Terms") govern your use of the TOMMY dashboard (the "Service") at office.tommysense.com, operated by TOMMY, a company registered in Denmark ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

These are the terms for individual users accessing the TOMMY dashboard. If you are an organisation purchasing access to the TOMMY platform, your terms are set out in the contract provided to you by TOMMY.

1. The Service

TOMMY is a spatial intelligence platform. As a user you can view live room occupancy, see which meeting rooms are available, and book rooms directly against your organisation's calendars. Access to specific features depends on the role your administrator has assigned to your account.

2. Accounts

You may be invited to create an account by an administrator at your organisation. You are responsible for keeping your credentials confidential and for all activity that happens under your account. Notify us at info@tommysense.com if you suspect unauthorised use.

3. Acceptable use

You agree not to:

  • Use the Service to violate any law or third-party right.
  • Attempt to access accounts, data, or systems you are not authorised to access.
  • Reverse-engineer, scrape, or otherwise extract data from the Service other than through features we explicitly provide.
  • Interfere with the Service's operation, security, or integrity, including by sending malware or performing denial-of-service attacks.
  • Use the Service to build a competing product or benchmark it for a competitor.

4. Your data

You own the data you submit through the Service (such as room bookings you create). You grant us a limited, non-exclusive licence to process that data solely to provide the Service to you, consistent with our Privacy Policy.

5. Warranties and disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. You use the Service at your own risk.

6. Limitation of liability

To the maximum extent permitted by law, TOMMY will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities. Our total cumulative liability arising out of or in connection with these Terms will not exceed EUR 100.

7. Indemnification

You will defend and indemnify TOMMY against third-party claims arising from your misuse of the Service, your violation of these Terms, or your infringement of applicable law or third-party rights.

8. Termination

You may stop using the Service at any time by contacting your administrator or us directly. We may suspend or terminate your access if you breach these Terms or if continued provision would expose us to material legal or security risk. On termination, you lose access to the Service and we will handle your data in line with our Privacy Policy.

9. Changes

We may update these Terms from time to time. The date at the top reflects the latest material revision. If changes are material, we will notify you in the Service and/or by email. Your continued use after the effective date constitutes acceptance.

10. Governing law and jurisdiction

These Terms are governed by the laws of Denmark, excluding its conflict-of-laws rules. The exclusive venue for any dispute arising out of or in connection with these Terms is the competent courts of Copenhagen, Denmark, unless mandatory consumer protection law requires otherwise.
